Thomas Hutchinson was on trial back in January in the manslaughter case when Judge Brantley Clark stopped the proceedings and declared a mistrial.

Clark determined, because Hutchinson smoked marijuana the night before, he was unable to help with his defense. In the second attempt just earlier this month, the mistrial was caused by a jury problem.

A jury has been selected. The trial is set to begin Tuesday at 9 am at the Bay County courthouse.
