Marianna, Fla. - The mother of a Jackson County boy who was accidentally shot and killed in January is facing charges in the case.
Whitney Smith is charged with child neglect with great bodily harm.
At the time of the investigation, no arrests were made in relation to who fired the shot.
But, Smith's boyfriend, Jaquarius White was arrested shortly after the incident. He was charged with felon in possession of firearm.
The investigation into what exactly happened the night Sims was shot, was initially unclear to law enforcement.
"After conducting a thorough investigation the sheriff's office filed an affidavit complaint to the state attorneys office, on February 27, 2018 against Whitney Smith, the mother of the six year old child," said Capt. Scott Edwards, Jackson County Sheriff's Office.
After coming to the conclusion that the shooting was an accident, the sheriff's office determined the only person who can be held responsible for the death, is Smith.
"State attorneys office issued a capias for the arrest of Whitney Smith for the neglect of a child causing great bodily harm," said Edwards.
Wednesday, officials with the Jackson County Sheriff's Office served Smith with a warrant for her arrest.
"On August 22, Smith was taken into custody and lodged in the Jackson County Correctional Facility," Edwards said.
Thursday morning, a county judge issued Smith a $1,500, cash only bond.
Along with that, Smith is not allowed to possess a firearm, and she must comply with DCF case plan.
Authorities still have not said who fired the fatal shot.
